a thing or two about www ethics

does the photo below look familiar?


that's because it was lifted from THIS blog, from my right sidebar! i was lying in bed, surfing the Facebook newsfeed on my iPhone, when something just moved me to click on this certain user's latest album. this user is a singaporean spree organiser (facebook name Glamourette Avenue), that conducts sprees for Kate Spade products, among other brands.

and to my horror, i noticed a very familiar picture in her album! it was a picture i took just a few weeks back of my kate spade iPhone case, and this user didn't even have the courtesy to credit me!

i was so angry at how brazen she is, i went ahead to shame her on my profile, and wait till you read her reply!



she had the cheek to feed me the line that she "didn't know it was a copyright picture", and that I should learn a thing or two about etiquette and courtesy???

if it's not taken by YOU, it's not yours. correct? it's common sense, isn't it? and did she think i'm new to Google? i use google too, to find pictures for my blog, and i give credit where credit is due! i indicate where the photos were taken from! even if it's not business ethics, its basic courtesy! does she think i'm stupid or something? when you click on a photo on Google Search, it tells you which website the photo is from! and please, even the photo URL can also tell you the website that is hosting the photo! so i was understandably furious when she fed me that load of horse sh*t. it's just some lame-a** bull crap.


HOW DUMB DOES SHE THINK I AM??

you know what? on hindsight, i don't believe she found the photo from Google. and this i am very sure about. because THAT photo didn't have the watermark, and it was saved as "Kate-Spade-Haves22.jpg" so unless you type in "kate spade haves" in google search, the photo won't even come up. if you key in "kate spade iphone case", the photo WITH the watermark "katespadeloveaffair.com" will come up instead.

so i am VERY sure she lifted it directly from my blog, and that story about finding it on Google is just horse sh*t. she couldn't use the one with the watermark see, so when she was directed to my blog, how happy she must be to find an alternative photo with no watermark! I'M NOT STUPID, B*TCH!!

and puh-lease. i don't need to watermark a picture to copyright it. i don't even need to do ANYTHING to copyright it! the minute i take a picture, it's MINE! i quote a website that touched on copyright issues:
"For a photographer, when you press the shutter release you are making a photo and gaining copyright to that photo at the same time. You don’t have to declare copyright or file any paperwork. It is yours to keep until you explicitly give it away or you die".

this is basically STEALING, to put it simply. she STOLE MY PICTURE to peddle her product. and she's saying i'm making a big fuss about it?? hell, i can do what i deem fit, since she clearly did as she pleased with MY PHOTO!

she should be shamed, in my opinion, because i'm pretty sure my photo isn't the only one she has stolen. i've looked through her photos, and recognised some from eBay US, which i'm damn sure is not hers. she's clearly devoid of any business ethics, basic manners and web etiquette!

how can i not be angry????

yes, i have no control whatsoever over who may steal my photos and use them without my permission, but i believe i am entitled to be furious here since i caught one such person committing the act. if she had asked me for permission to use the photo, i would have gladly said "go ahead!". hell, even if she hadn't asked for permission, but credited me in her album, i wouldn't have been this angry.

but no!
she had the nerve to "teach" me etiquette and courtesy, feed me those lame excuses, and tell me to go "mirror myself"?? if i could reach into the computer and SMACK her, i would! argh!!!

  1. Good for you. I am still trying to get my blog up and running and this is one thing that I worry about. Some people have no clue! Anyways it is a great read and I love the fact that you stood your ground. Right on! Keep them coming!

    i added another paragraph to the post, where i said in hindsight i don't think she really found the picture on Google. the photo in question was saved as "Kate-Spade-Haves22.jpg".
    so unless you key in "kate spade haves" in google search, the photo won't even come up. and what are the odds she'd key those words in to look for pics of a Kate Spade iphone cover??

    so i think she searched for "kate spade iphone case" and found instead the bigger picture with the watermark "katespadeloveaffair.blogspot.com" that was used in my blogpost, was directed to my website, found the alternative pic on my sidebar with NO watermark, and thus used that one instead.

    so that story about finding it on google is a lie. she clearly stole it direct from my blog.

    argh!


    anyway...i can't wait to read your blog! i don't think there's much we can do to protect our photos. when we post them, we must be prepared to have them used without permission. sigh. we can only hope more users will be ethical enough to give us credit or ask for our permissions first. =)

  3. Good god, what a total b****! You have every right to be angry, that photo is truly yours! Dah buat salah bukan nya nak apologise, can be defensive and insult you some more! It's a good thing you didn't take this lying down, otherwise she would happily continue grabbing other people's photos and passing them off as hers..

    I guess this incident will further deepen your hatred for blogshops / spree-ers!

  4. yeah it is a bit annoying she did that, but this post is so overly dramatic and I couldn't even read it all because I didn't want to get all wound up. this type of shit happens and there's no reason to have a big anger fest over it. what's the big deal anyways? It's not like you aren't copying other copyrighted work too. How about the KS pattern you made and put on your Iphone as the screensaver? I'm pretty sure that pattern is copyrighted! So I guess you gotta look at yourself too!

  5. Yes, but I did not CLAIM THE PHOTO OR ARTWORK AS MINE LIKE SHE HAS!! there's a huge difference there. You really shld hv read the post till the end.

    And why am I being overly dramatic? Because she was not the slightest bit remorseful and still had the nerve to insult me! If she had been apologetic, I would not have been moved to write this post.

  6. I think this is a trivial matter which got a pretty unnecessary drama top to it. Though she was in the wrong, you could have handled it privately without shaming anyone. Thus the retaliation reply. For a sec, I really thought the photo she "plagiarized" was a professional shot that could be making money for prints. To me, it's just like any other photo I took with anyone's cam. True, it's yours but c'mon...

    People are bound to make mistakes and when you know something is wrong, handle it with class. Shaming them in public is just cheap.

  7. i don't think i need to justify my actions to you, but what the hell, i'll enlighten you.

    i did what i deemed fit. not only did she steal my photo, SHE CLAIMED IT HER OWN. THAT is the problem i have with the whole thing.

    you can judge me for my actions as you please. i wont judge you for condoning her behavior and calling it a "trivial matter". though i must say, it gives me an idea of your values and morals.

    she'll remove my photo, but then will her infringement actions ever stop? she'll just do it again! and there're so many other photos i saw from her albums that were taken from eBay US! not hers at all!

    and she has the nerve to say "all pictures featured in the photo albums belong to Glamourette Avenue"???????

    and now YOU want to insult me and my property (ie. photo)? its beginning to appear to me like you're one of her yes-men, sent to defend her, so with that i'll stop right here, because i don't think i need to waste my breath.

  8. let me put this in another light to explain why it's NOT a "trivial matter" to me.

    she runs a BUSINESS.
    so how can she use another person's photo to peddle her products? can't she use her own? or even a stock photo perhaps if she can't take her own?

    i run a business too. i sell diaper cakes.
    what happens if i use ANOTHER PERSON's diaper cake photo, not a "professional shot that could be making money for prints" and one that is "just like any other photo taken with anyone's cam", then claim it as my own, and use it to peddle my diaper cakes?

    will it still be a "trivial matter" then?
    it's still stealing, if you ask me.

    and what "drama"?
    did i sue her? did i go to the cops?

    i am merely venting MY frustrations on MY blog, on MY facebook profile. am i not entitled to do so? yes, it is at her expense, but really, can you not blame her after all the lame excuses (not knowing its copyrighted, blah blah blah) and the low insults? jeez!

  9. that disclaimer on that blog is such a slap on the face. grab photos that belong to other people and then claim them as her own. what utter hypocritical rubbish. RUBBISH!!

  10. You have every right to be mad because she claimed the it's hers. I can't believe she actually have a disclaimer that says the photo belongs to her.

    With that said, I think calling her a b*tch is a little too harsh.
